What Happens If You Die Without a Will in South Africa?

In South Africa, passing away without a valid will, known as dying intestate, means your estate is distributed according to the Intestate Succession Act 81 of 1987, as amended up to April 2024. This legal framework determines how your assets are allocated, which may not align with your personal wishes.

How Is Your Estate Distributed?
The Act outlines a hierarchy for inheritance:

Spouse and Children: If survived by both, your spouse inherits the greater of R250,000 or a child’s share, with the remainder divided equally among your children.
Spouse Only: If no children, the spouse inherits the entire estate.
Children Only: If no spouse, children inherit the estate equally.
No Spouse or Children: The estate goes to parents, then siblings, and further extended family if necessary.

*Note: The Act now recognizes permanent life partners, including same-sex partners, as beneficiaries, provided the relationship’s permanence can be proven.

Role of the Master of the High Court
All estates without a valid will are reported to the Master of the High Court, who appoints an executor to manage the estate’s administration. This includes asset valuation, debt settlement, and distribution to heirs.
